1. About TalaHmong.com

TalaHmong.com is an online multi-vendor marketplace that connects independent sellers (“Vendors”) with customers (“Buyers”). TalaHmong.com does not manufacture, own, or directly sell products unless explicitly stated.

2. Eligibility

You must be at least 18 years old to use the Platform. By using TalaHmong.com, you represent that you are legally able to enter into a binding agreement.

3. Account Registration

  • You may be required to create an account to purchase or sell products.

  • You agree to provide accurate, complete, and up-to-date information.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • TalaHmong.com is not responsible for unauthorized access caused by your failure to secure your account.

4. Marketplace Role & Disclaimer

  • TalaHmong.com acts solely as a marketplace facilitator.

  • Vendors are responsible for:

    • Product descriptions and images

    • Pricing and inventory

    • Shipping and delivery

    • Compliance with laws and regulations

  • TalaHmong.com is not a party to transactions between Buyers and Vendors.

5. Vendor Responsibilities

Vendors agree to:

  • Provide truthful and lawful product listings

  • Comply with U.S. laws, including consumer protection, customs, tax, and import/export laws

  • Ship orders promptly and accurately

  • Handle returns, refunds, and customer service in accordance with Platform policies

  • Pay applicable platform fees, commissions, and service charges

TalaHmong.com reserves the right to suspend or terminate Vendor accounts for violations.

6. Orders, Payments & Fees

  • Payments are processed through third-party payment processors.

  • TalaHmong.com may collect commissions or service fees from Vendors.

  • Prices, taxes, and shipping fees are displayed at checkout.

  • TalaHmong.com is not responsible for payment processor errors or delays.

7. Shipping, Returns & Refunds

  • Shipping timelines and policies are set by individual Vendors.

  • Returns and refunds are subject to each Vendor’s policy unless otherwise stated.

  • TalaHmong.com may assist in dispute resolution but does not guarantee outcomes.

8. International Sellers & Buyers

  • Vendors shipping from outside the U.S. are responsible for customs compliance.

  • Buyers may be responsible for import duties, VAT, or customs fees.

  • TalaHmong.com is not responsible for customs delays or seizures.

9. Intellectual Property

  • All content on TalaHmong.com, including logos, text, graphics, and software, is owned by or licensed to TalaHmong.com.

  • Vendors retain ownership of their product content but grant TalaHmong.com a license to display it.

  • Unauthorized use of content is prohibited.

10. Prohibited Activities

You agree not to:

  • List illegal, counterfeit, or prohibited products

  • Misrepresent products or pricing

  • Violate intellectual property rights

  • Engage in fraud, abuse, or harassment

  • Attempt to disrupt the Platform’s security or functionality

11. Account Suspension & Termination

TalaHmong.com may suspend or terminate accounts at its sole discretion for:

  • Violations of these Terms

  • Fraudulent or unlawful activity

  • Harm to users or the Platform

12. Limitation of Liability

To the fullest extent permitted by law:

  • TalaHmong.com is not liable for indirect, incidental, or consequential damages

  • TalaHmong.com is not responsible for Vendor products, actions, or omissions

  • Total liability shall not exceed the amount paid to TalaHmong.com in the prior 12 months

13. Indemnification

You agree to indemnify and hold harmless TalaHmong.com from claims arising out of:

  • Your use of the Platform

  • Your violation of these Terms

  • Your products or transactions

14. Privacy

Your use of TalaHmong.com is subject to our Privacy Policy, which explains how we collect and use personal information.

15. Governing Law

These Terms are governed by the laws of the United States and the State of [Insert State, e.g., Minnesota], without regard to conflict-of-law principles.
