1. Introduction

Welcome to TalaHmong.com. To maintain a safe, fair, and trusted marketplace for customers and sellers, all sellers must follow these rules. By listing products on TalaHmong.com, you agree to these policies and any future updates.

2. Seller Eligibility

Sellers must:

  1. Be at least 18 years old or legally permitted to enter into contracts.

  2. Provide accurate business information, including legal name, address, contact info, tax IDs, and bank account details for payouts.

  3. Comply with all applicable federal, state, and local laws.

3. Product Listing Requirements

Permitted Items

Only legal products may be sold. Sellers must ensure:

  • The product is authentic and original (unless disclosed as a replica with rights).

  • Descriptions and images are accurate and truthful.

  • The product category is appropriate.

Prohibited Items

Sellers are strictly prohibited from listing:
❌ Counterfeit or trademark-infringing items
❌ Illegal products (weapons, drugs, stolen goods)
❌ Hazardous or restricted items without proper compliance
❌ Adult-only content

Exact prohibited lists will be published and updated periodically.

Listing Standards

Each product listing must include:

✔ Detailed description
✔ Accurate pricing
✔ High-quality images
✔ Condition (New / Used / Refurbished)
✔ Shipping details

No misleading or sexually explicit content, hate speech, or offensive branding is allowed.

4. Accurate Product Descriptions

Sellers must:

  • Not mislead buyers.

  • Include all material facts (size, material, brand, origin).

  • Disclose defects or used condition if applicable.

If mistaken listings are flagged repeatedly, the seller may face listing removal or account restrictions.

5. Pricing & Fees

Sellers agree that:

  • All prices are in USD.

  • Prices must include all mandatory fees unless otherwise specified.

  • TalaHmong.com charges fees for transactions, including commissions and processing fees (detailed in your seller dashboard).

  • Fees are non-refundable, unless required by law.

6. Orders, Fulfillment & Shipping

Sellers are responsible for:
✔ Fulfilling orders on time
✔ Providing tracking information when available
✔ Packing products securely
✔ Complying with shipping standards and timelines

If a seller fails to fulfill an order within the required timeframe, the order may be canceled and refunded, and penalties may apply.

7. Returns, Refunds & Disputes

Return Policy

Unless otherwise specified, all products are:

➡️ Returnable within X days with buyer paying return shipping (depending on seller preference, but must be clearly stated in listing).

Refund Standards

Refunds must be processed within 3 business days of approved return.

Dispute Resolution

If a buyer disputes a transaction:

  2. TalaHmong.com may intervene and make a final ruling.

  3. Sellers must abide by all rulings.

8. Prohibited Behavior

Sellers must NOT:
🚫 Manipulate reviews or ratings
🚫 Misrepresent products or shipping times
🚫 Create duplicate or spam listings
🚫 Use buyer data for external marketing without consent
🚫 Solicit off-platform transactions to avoid fees

Violations can lead to warnings, account suspension, or permanent bans.

9. Seller Performance & Penalties

Performance is monitored based on:

⭐ On-time shipping
⭐ Cancellation rates
⭐ Customer ratings

Low performance may lead to:
⚠ Warnings
🔒 Restricted selling privileges
❌ Account suspension or termination

10. Intellectual Property

Sellers must respect the intellectual property rights of others.
If a claim is filed:
✔ The seller must prove rights to sell or distribute the product.
✔ Listings that infringe will be removed immediately.

Repeat infringement leads to termination.

11. Payouts & Payments

✔ Payments are processed via integrated payment systems.
✔ Sellers receive payouts on a scheduled basis (e.g., weekly, biweekly).
✔ Payouts may be held for quality or dispute review.
✔ Sellers are responsible for their own tax reporting.

12. Taxes

Sellers are responsible for all applicable taxes including:

🔹 VAT / GST (international sellers)
🔹 Income or business taxes

TalaHmong.com may collect tax info for compliance but is not responsible for individual tax obligations.

13. Privacy & Data

Sellers must not:
❌ Share buyer emails or private data
❌ Use buyer info outside the TalaHmong.com platform for marketing without explicit consent

Buyer and seller data is protected under the platform’s privacy policy.

14. Account Suspension & Termination

TalaHmong.com reserves the right to:

  • Suspend accounts for violations.

  • Terminate accounts for severe or repeated breaches.

  • Withhold payouts pending investigations.

Sellers may appeal decisions via support.

15. Modification of Rules

TalaHmong.com may update these rules at any time.
Sellers will be notified of major changes and must comply within the specified timeframe.
